Summary
Interpretation and effect of: (a) the proviso, attached to Article 3(1) [Attachment 2] of the Enforcement Decree of the Act on the Establishment and Operation of Private Teaching Institutes and Extracurricular Activities, on ¡°the curriculum for the types of private teaching institutes,¡± providing that dance as the curriculum of a private teaching institute for lifelong education or vocational training shall ¡°exclude dance institute businesses under the Installation and Utilization of Sports Facilities Act¡±; and (b) the proviso attached to Article 6 Item 7 [Attachment 2] of the Enforcement Decree of the Installation and Utilization of Sports Facilities Act, stating that ¡°private teaching institutes under the Act on the Establishment and Operation of Private Teaching Institutes and Extracurricular Activities shall be excluded¡± In a case where a person who wishes to establish and operate a private teaching institute teaching international standard dance (ballroom dance) registers the said institute as either a dance institute business under the Installation and Utilization of Sports Facilities Act or a private teaching institute for lifelong education or vocational training under the Act on the Establishment and Operation of Private Teaching Institutes and Extracurricular Activities, whether the relevant administrative authority can refuse the granting of the report or registration of a private teaching institute that meets the requirements for report and registration under the relevant legislation
