Summary
In a case where a physician breached his/her duty of due care as a good manager, thereby resulting in irrevocable damage to a patient¡¯s bodily function, and continued treatment to merely cure the aftereffects or prevent them from aggravating, whether a hospital can charge a patient for surgeries and medical treatments (negative), and whether this legal principle likewise applies to a case where the patient failed to file a claim for the payment of medical expenses for treatment, which was expected to be incurred after a certain point in the future, in previous lawsuits, and where it is prohibited by the Civil Procedure Act to claim for those medical expenses in a separate lawsuit, because such claim would be contrary to the res judicata effect of the final and conclusive judgment rendered in the previous lawsuit (affirmative in principle)
