The sentencing guidelines are applied as follows:

 Determine the type of offense after deciding on the offense group for the offense at issue. The type of offense is to be decided by following the specified definitions contained in the sentencing guideline.

 The guideline provides three sentencing ranges for each offense type. Pursuant to this, select one sentencing range after analyzing and assessing the special sentencing factors.

 After the appropriate sentencing range is selected, the sentencing court may impose the appropriate sentencing period taking into account the overall circumstances. The general sentencing determinants, as well as the special sentencing determinants, should be taken into account. If there are reasonable reasons to consider different general sentencing determinants not contained in the sentencing guideline, then consider the determinants as a whole.

 If the sentencing court imposes a sentence of less than three years (with or without prison labor), the judge may determine whether a suspension of sentence is appropriate. The guideline contains applicable assessing factors for determining suspension of sentencing as well as offense type and period of sentencing. The primary consideration factors are compared to consider execution of sentence or suspension of sentence.
